These Terms of Service ("Terms") govern your access to and use of the Mar-e AI website, applications, and services (collectively, the "Service") operated by Mar-e AI ("Mar-e", "we", "us", or "our"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Mar-e AI provides AI-assisted tools that help users generate branded social media designs (static posts, stories, and carousels) in Arabic and English. Outputs depend on the inputs you provide (brand assets, prompts, edits) and the underlying AI models, and may vary in quality and style.
2. Eligibility & Account
- You must be at least 16 years old (or the age of digital consent in your country).
- You are responsible for the security of your account credentials and for all activity on your account.
- You agree to provide accurate information and to keep it up to date.
3. Subscriptions, Credits & Billing
The Service is offered on a freemium basis with paid plans (Starter, Pro, Business). Paid plans are billed monthly in advance through our payment processor, Paddle.com Market Ltd. ("Paddle"), which acts as the merchant of record. Each plan includes a monthly allotment of creative energy credits used to generate designs. Unused monthly credits do not roll over.
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account dashboard; cancellation takes effect at the end of the current paid period and you retain access until then. Prices and plan contents may change with prior notice.
4. Acceptable Use
You agree not to use the Service to create, upload, or distribute content that:
- infringes any third party's intellectual property, privacy, or other rights;
- is unlawful, defamatory, harassing, hateful, sexually explicit, or violent;
- depicts minors in a sexual or inappropriate context;
- impersonates a real person or brand without authorization;
- contains malware, attempts to disrupt the Service, or scrapes it at scale;
- circumvents usage limits, credit systems, or access controls.
We may remove content and suspend or terminate accounts that violate these Terms, with or without notice.
5. Restrictions — No Cloning, Scraping, or Reverse Engineering
The look, feel, structure, flows, prompts, models-in-use, and underlying design pipelines of the Service are the proprietary work product of Mar-e AI. In addition to the general rules above, you specifically agree that you will NOT, and will not permit or assist any third party to:
- copy, clone, mirror, or create a substantially similar product, service, or user interface based on the Service — including its onboarding flow, brand-DNA extraction, creative director chat, prompt studio, generation modes, layout system, or Arabic typography treatments;
- scrape, crawl, harvest, or systematically extract any part of the Service, its outputs, its HTML/CSS/JS, API responses, or its user interface (whether by manual, automated, headless-browser, or AI-agent means);
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, prompts, model instructions, or trade secrets behind the Service, except to the limited extent this restriction is prohibited by applicable law;
- use the Service, its outputs, or any data obtained from it to train, fine-tune, evaluate, benchmark, or otherwise develop any AI model, prompt library, dataset, or competing product;
- resell, sublicense, rent, lease, or provide the Service (or credits, API access, or generation capacity derived from it) to third parties without our prior written consent;
- remove, alter, or obscure any copyright, trademark, watermark, or attribution notice on the Service or its outputs;
- use bots, headless browsers, credential stuffing, shared accounts, or any technical means to bypass authentication, rate limits, credit accounting, trial limits, or other access controls.
Nothing in the Service is sold to you. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your own internal business or personal creative purposes only, subject to these Terms. All rights not expressly granted are reserved by Mar-e AI.
Violations of this section cause irreparable harm for which monetary damages would be inadequate, and we may seek injunctive relief in addition to any other remedies available at law or in equity, without the requirement of posting a bond.
6. Intellectual Property
Mar-e AI, "مرئي", the Mar-e logo, and all associated names, marks, product designs, interface designs, screens, and content (other than Your Content and Generated Outputs) are the property of Mar-e AI and are protected by copyright, trademark, and other intellectual property laws. You may not use our name or marks without our prior written permission.
7. Your Content & License
You retain ownership of the brand assets and prompts you upload ("Your Content"). You grant Mar-e a worldwide, non-exclusive, royalty-free license to host, process, transmit, and modify Your Content solely to operate, secure, and improve the Service. You represent and warrant that you have the rights necessary to upload Your Content and to use the outputs.
8. Generated Outputs
Subject to your compliance with these Terms and applicable law, you own the designs you generate through the Service. AI outputs are produced from probabilistic models and may, in rare cases, resemble third-party content. You are responsible for reviewing outputs before using them publicly or commercially.
9. Third-Party Services
The Service relies on third-party providers (including AI model providers, cloud hosting, and Paddle for payments). Their terms and privacy practices apply to the relevant interactions. We are not responsible for third-party services beyond our reasonable control.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not guarantee that outputs will meet your expectations or be free of errors.
11. Limitation of Liability
To the maximum extent permitted by law, Mar-e and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to the Service. Our aggregate liability for any claim shall not exceed the amounts you paid us in the 12 months preceding the event giving rise to the claim.
12. Termination
You may stop using the Service at any time and delete your account from the dashboard. We may suspend or terminate access if you breach these Terms (in particular Section 5) or if required by law. Sections that by their nature should survive termination will survive.
13. Changes
We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws applicable at the location of Mar-e AI's principal place of business, without regard to conflict-of-law principles. Disputes shall be resolved in the competent courts of that jurisdiction.
