This Privacy Policy explains how Mar-e AI ("Mar-e", "we", "us") collects, uses, shares, and protects personal data when you use our website and services (the "Service"). We are the data controller for the personal data described below.
1. Data We Collect
- Account data: name, email address, password hash, profile preferences, authentication provider identifiers (e.g. Google sign-in).
- Brand & content data: brand names, logos, colors, fonts, descriptions, prompts, and the designs you generate or edit.
- Usage data: credits consumed, feature interactions, device and browser information, IP address, log timestamps, and error reports.
- Billing data: processed by Paddle.com Market Ltd. ("Paddle"), our merchant of record. Mar-e receives transaction status, plan, and partial billing metadata, but does not store full payment card numbers.
- Communications: messages you send to support and our replies.
2. How We Use Data
- To provide, operate, secure, and improve the Service.
- To process subscriptions, credits, refunds, and tax compliance via Paddle.
- To generate AI designs based on the inputs you submit.
- To prevent abuse, fraud, and violations of our Terms.
- To send transactional emails (receipts, security notices, service updates).
- To comply with legal obligations.
We do not use your brand assets, prompts, or generated outputs to train foundational AI models. Inputs may be transiently sent to third-party AI providers (see Section 4) solely to fulfill your generation requests.
3. Legal Bases (GDPR)
- Contract: to deliver the Service you signed up for.
- Legitimate interests: to secure the Service, prevent abuse, and improve quality.
- Legal obligation: tax, accounting, and regulatory requirements.
- Consent: where required (e.g. certain cookies or marketing emails); you may withdraw it at any time.
4. Sharing Data
We share personal data only with processors that help us operate the Service, including:
- Paddle.com Market Ltd. — payment processing and merchant-of-record services.
- Cloud hosting & database providers — to store and serve your account and content.
- AI model providers — to process prompts and brand inputs to generate designs.
- Email & analytics providers — for transactional email and aggregate product analytics.
- Law enforcement or regulators — when legally required.
We do not sell your personal data.
5. International Transfers
Personal data may be processed in countries outside your own, including the United States and the European Union. Where required, we rely on Standard Contractual Clauses or other lawful transfer mechanisms to protect your data.
6. Retention
We retain account and content data while your account is active and for a limited period afterwards to comply with legal obligations, resolve disputes, and enforce our agreements. Billing records are retained as required by tax law (typically up to 7 years). You may request earlier deletion as described below.
7. Your Rights
Depending on your jurisdiction, you may have the right to:
- access, correct, or delete your personal data;
- object to or restrict certain processing;
- data portability;
- withdraw consent at any time;
- lodge a complaint with a supervisory authority.
To exercise these rights, email support@mar-e.com. We will respond within the timeframes required by applicable law.
8. Security
We use industry-standard measures, including TLS encryption in transit, encrypted storage, access controls, row-level security on our database, and audit logging. No system is 100% secure; please use a strong password and protect your credentials.
9. Cookies
We use a small number of cookies and similar technologies that are strictly necessary to keep you signed in and to remember your preferences, plus aggregated analytics to improve the Service. You can control cookies through your browser settings.
10. Children
The Service is not directed to children under 16. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, contact us so we can delete it.
11. Changes
We may update this Policy from time to time. Material changes will be communicated via the Service or by email.
